Procedure

1. Receiving an Appeal

After receiving an appeal the Registry scrutinizes the appeal as per the checklist and report on Limitation. In case of any shortcoming/discrepancy, an objection memo will be sent to the appellant to remove the shortcoming/discrepancy

2. Listing of Appeal

Upon receipt of the appeal which is found to be in order, Registry issues the notice to the BFC requiring the production of the comments and findings of the Examining Commitee of the CBFC and its case may be. Further, the said notice shall also notify the date of hearing fixed for the appeal calling for the CBFC to avail of the opportunity of hearing under Section 5D (11). CBFC is required to furnish the findings of the Examining Committee and / or Revising Commitee, as the case may be within the specified period. The said communication shall notify the CBFC the actual date of hearing fixed to enable it to avail of the opportunity under Section 5D (11). Normally appeals are to be listed in the chronological order in which they are received subject to directions, if any by the Chairperson for urgent hearing.

3. Decorum to be observed during hearing of Appeal

The appeallant or his representative and CBFC's representative shall give the opportunity of being heard in appeal on the day of the viewing of the film by the Tribunal or later, as may be convenient. Appellants and its representatives may be permitted to be present during viewing of the film. Howerver, they shall observe the decorum to enable the Members of the Tribunal to view the film uninterruptedly, subject to the representatives giving answer/explanation to any queries that may come from the Tribunal

4. FCAT Orders

The orders signed by the Tribunal are uploaded on the website of the FCAT. A hardcopy of the orders are mailed to the Appellants and CBFC.
